WHAT: The Indiana Air Pollution Control Board (board) will hold a public hearing for outdoor hydronic heaters / outdoor wood boilers , 326 IAC 4-3 (LSA #05-332).
 
WHEN: Wednesday, June 2, 2010, 6:00 p.m. EDT
 
WHERE: Columbus East High School, Auditorium, 230 South Marr Road, Columbus, Indiana
 
WHY: The purpose of this hearing is to receive public comment on a new rule, 326 IAC 4-3 that is proposed for preliminary adoption by the board.  All interested persons are invited and will be given reasonable opportunity to express their views concerning the proposed action.
 
Note: There are hearings for other rules that are scheduled for adoption by the board starting at 4:00 p.m.
 
Key points of the outdoor hydronic heater rule – IDEM’s proposal for public hearing on June 2, 2010
 
Rural considerations:
No stack height requirement (as long as no neighbors within 150 feet)
Can operate year round (as long as no neighbors within 300 feet)
 
Existing units not certified through the U.S. Environmental Protection Agency
Burn clean wood
20% opacity limit (this can be met using good combustion practices and with proper maintenance of the unit)
Stack height requirement of 5 feet higher than a neighbor’s building (within 150 feet) – maximum stack height of 22 feet
Cannot operate June through August (if neighbors within 300 feet)
 
Newly manufactured units:
Must be Phase 2 certified through U.S. EPA’s voluntary outdoor hydronic heater program
Sell-through provisions for existing non-Phase 2 units in a Indiana dealer’s inventory

Next steps following First Public Hearing:
Proposed rule will publish in the Indiana Register with an additional comment period
Second Public Hearing  / final adoption
Rule will not be effective until January 2011, at the earliest, September 2011 for stack height requirement
